These Terms and Conditions of Sale (the “T&Cs”) govern distance sales concluded on the Site between:

and any natural person acting for non-professional purposes (the “Customer”).

These T&Cs apply exclusively to orders placed on the Site, paid for online and collected in store under the Click & Collect service.

They do not apply to purchases made directly in store, which remain subject to the rules applicable to sales made on the premises.

Monaco regulations on contracts concluded electronically require, in particular, clear pre-contractual information on the identity of the seller, the price, payment and performance terms, the steps for concluding the contract, the means of correcting errors, and whether or not a right of withdrawal exists.

Article 1 – Purpose

These T&Cs define the conditions under which the Customer may order online products offered by SARL Eeny Meeny Monaco and collect them exclusively in store.

No home delivery is offered under these T&Cs, unless expressly stated otherwise on the Site.

Article 2 – Products

The products offered for sale are those displayed on the Site, subject to availability.

SARL Eeny Meeny Monaco endeavours to present the essential characteristics of the products as accurately as possible. The photographs, visuals, descriptions and information shown on the Site are provided for guidance only and shall not have absolute contractual value.

Article 3 – Prices

Prices are stated in euros.

Unless otherwise stated, the prices displayed on the Site are inclusive of all taxes.

SARL Eeny Meeny Monaco reserves the right to change its prices at any time. The applicable price is the one displayed on the Site at the time the Customer validates the order.

Article 4 – Orders

The Customer selects the products they wish to purchase and adds them to their basket.

Before finally confirming the order, the Customer may check the details of the order, its total price, correct any errors and amend the basket.

The order is only finally recorded once online payment has been validated and a confirmation email has been sent.

SARL Eeny Meeny Monaco reserves the right to refuse or cancel any order in the event of suspected fraud, payment irregularity, obvious pricing error, technical error, or product unavailability.

Article 5 – Payment

Payment is made online at the time of the order, via a secure solution provided in particular by Payplug.

SARL Eeny Meeny Monaco does not store the Customer’s full bank card details.

The order will only be prepared once payment has been effectively confirmed.

Article 6 – In-store collection

Orders placed on the Site must be collected exclusively from the following address:

The Customer will be informed by email, or by any other means indicated on the Site, when the order is ready for collection.

The order must be collected within 15 days from the date the availability notice is sent.

At the time of collection, proof of identity and, where applicable, the order confirmation may be requested.

If collection is carried out by a third party, SARL Eeny Meeny Monaco may request any useful supporting document allowing verification of the identity of the person collecting the order and their authorisation.

If the order is not collected within the period stated above, SARL Eeny Meeny Monaco may contact the Customer at the email address provided when placing the order.

If the Customer does not reply or the order is not collected within a further reasonable period, SARL Eeny Meeny Monaco may cancel the order and issue the corresponding refund using the same payment method as that used when placing the order, unless technically impossible or otherwise expressly agreed.

Article 7 – Unavailability

If a product becomes unavailable after the order has been placed, SARL Eeny Meeny Monaco will inform the Customer as soon as possible and, depending on the circumstances, will refund the unavailable product or the entire order if it cannot be fulfilled.

Article 8 – Right of withdrawal

In accordance with the Monaco framework applicable to distance contracts, the consumer has a period of seven clear days to exercise the right of withdrawal, except where legal exceptions apply. Monaco Law No. 1.383 provides for this seven clear day period and states that where the legally required information has not been provided, this period is extended to three months.

The Customer must return the product in its original condition, complete, unused, undamaged, together with its original packaging and proof of purchase.

The refund will be made within a reasonable period after receipt and verification of the returned product, using the same payment method as that used for the order, unless otherwise expressly agreed.

The right of withdrawal does not apply to products excluded by the applicable regulations, in particular where they have been personalised, made to the Customer’s specifications, or cannot be returned for reasons relating to their nature, hygiene or preservation, if they have been unsealed or used.

Article 9 – Complaints, exchanges and returns

Any complaint relating to an order must be sent as soon as possible to:

In the event of a defective or non-compliant product, the Customer is invited to contact SARL Eeny Meeny Monaco, enclosing, where possible, photographs and the order number.

Any exchange or refund arrangements granted on a commercial basis remain at the discretion of SARL Eeny Meeny Monaco, subject to the Customer’s applicable legal rights.

Article 10 – Liability

SARL Eeny Meeny Monaco shall not be held liable for damage resulting from misuse of the purchased product, use not in accordance with its intended purpose, or failure to comply with the age, safety or supervision instructions applicable to children’s products.

SARL Eeny Meeny Monaco shall likewise not be liable in the event of non-performance or improper performance of the contract attributable either to the Customer or to a case of force majeure.

Article 11 – Personal data

The personal data collected in connection with orders is processed in accordance with the Site’s Privacy Policy.

Article 12 – Intellectual property

All elements of the Site remain the exclusive property of SARL Eeny Meeny Monaco or their respective owners. No right of reproduction or use is granted to the Customer without prior written authorisation.

Article 13 – Applicable law and competent jurisdiction

These T&Cs are governed by Monaco law.

In the event of a dispute, the parties shall first seek an amicable solution.

Failing amicable agreement, jurisdiction is assigned to the competent courts of the Principality of Monaco, subject to the mandatory consumer protection rules that may apply.

Article 14 – Amendments to the T&Cs

SARL Eeny Meeny Monaco reserves the right to amend these T&Cs at any time.

The applicable version is the one in force on the date of the order.
